These Terms of Service (“Terms”) govern your use of Client Console Scheduler (“Client Console”, “the Service”), operated by Eye Heru (“we”, “us”). By creating an account or connecting a social account, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Client Console is a scheduling tool that lets you connect social accounts you own or manage and compose, schedule, publish and review posts for them. Features may change, and we may add, modify or discontinue any part of the Service.

2. Eligibility and accounts

  • You must be at least 13 years old (16 in the EEA/UK) and able to form a binding contract.
  • You are responsible for the accuracy of your account information and for keeping your login credentials secure.
  • You are responsible for all activity under your account.
  • Notify us at eyeheru369@gmail.com if you suspect unauthorised access.

3. Connected accounts and authorisation

You may only connect Facebook Pages, Instagram professional accounts or other social accounts that you own or are authorised to manage. By connecting an account you authorise Client Console to act on your behalf within the permissions you grant, including publishing, scheduling, editing and deleting content and reading post performance data.

You may revoke this authorisation at any time by disconnecting the account in Client Console or by removing the app in your Facebook settings under Settings & Privacy → Settings → Apps and Websites.

4. Your content

You retain all ownership of the content you upload or schedule. You grant us a limited, non-exclusive, worldwide licence to host, store, reproduce and transmit that content solely to operate the Service and to publish it to the destinations you select. This licence ends when you delete the content or your account.

You represent that you hold all rights necessary to publish your content and that it does not infringe anyone’s rights.

5. Acceptable use

You agree not to:

  • Use the Service to post unlawful, infringing, defamatory, harassing, hateful, deceptive or sexually exploitative content.
  • Post spam, run engagement-farming schemes, or use the Service for coordinated inauthentic behaviour.
  • Violate the terms, policies or community standards of any connected platform, including the Meta Platform Terms, Developer Policies and Community Standards.
  • Attempt to access accounts, data or systems you are not authorised to access.
  • Reverse engineer, scrape, overload or interfere with the Service or circumvent rate limits.
  • Resell or redistribute data obtained through the Service.

We may suspend or terminate accounts that breach this section, with or without notice.

6. Third-party platforms

The Service depends on third-party APIs that we do not control. Those platforms may change, restrict, rate-limit or revoke access at any time, which may cause scheduled posts to fail, be delayed, or be rejected. We are not responsible for platform outages, policy changes, or actions a platform takes against your accounts. Your use of each platform remains governed by that platform’s own terms.

7. Availability

The Service is provided on an “as available” basis. We do not guarantee that any scheduled post will publish at an exact time or at all. You are responsible for verifying that time-sensitive content was published.

8. Fees

If a paid plan is offered, pricing and billing terms will be presented before purchase. Unless stated otherwise, fees are billed in advance and are non-refundable except where required by law. We will give notice before any price change.

9. Intellectual property

The Service, including its software, design and branding, is owned by Eye Heru and protected by intellectual property law. These Terms grant you a limited, revocable, non-transferable right to use the Service; no other rights are granted.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law or a platform, or if we discontinue the Service. On termination your data is deleted as described in the Privacy Policy.

11. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure or error-free.

12. Limitation of liability

To the fullest extent permitted by law, Eye Heru will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost data, lost goodwill, or missed publishing opportunities, arising from or related to your use of the Service. Our total aggregate liability for all claims will not exceed the greater of (a) the amount you paid us in the twelve months before the claim, or (b) USD 100.

Nothing in these Terms excludes liability that cannot be excluded by law.

13. Indemnity

You agree to indemnify and hold harmless Eye Heru from any claim, loss or expense (including reasonable legal fees) arising from your content, your use of the Service, or your breach of these Terms or of a platform’s terms.

14. Changes to these Terms

We may update these Terms. If a change is material we will update the effective date above and, where we have your email address, notify you before it takes effect. Continued use after that date constitutes acceptance.

15. Governing law

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of law rules. The courts located in Georgia will have exclusive jurisdiction, except where mandatory local law gives you the right to bring a claim elsewhere.
